DELIVERY & COLLECTION TERMS

Infinite Vehicle Sales Ltd

Infinite Vehicle Sales Ltd offers delivery services as a separate transaction.

This page explains how delivery works, what is included, and your responsibilities as the buyer.

🟠🔴 1. DELIVERY OF AMBER & RED VEHICLES (TRADE / DUTCH AUCTION)

Amber and Red vehicles are sold strictly as seen, under trade Dutch auction terms, and not as retail consumer purchases.

Amber Vehicle Delivery
• Amber vehicles may start and drive but are unprepared, uninspected, and may be roadworthy or unroadworthy.
• Delivery does not imply roadworthiness, fitness for purpose, or any warranty from Infinite Vehicle Sales Ltd.
• A complimentary third-party warranty may be included where stated; this:
• Does not alter the trade sale classification
• Must be claimed directly through the warranty provider

Red Vehicle Delivery
• Red vehicles may be non-runners, MOT failures, or unsafe, and must be treated as non-roadworthy.
• These vehicles must be transported or recovered, not driven.
• Delivery is transportation only, with no guarantee of any mechanical condition.

⚠️ IMPORTANT LEGAL INFORMATION – TRADE VEHICLES

All Amber and Red vehicles are sold under trade terms, meaning:
• Sold as seen, with no warranty or guarantee from Infinite Vehicle Sales Ltd
• No implied terms (e.g., satisfactory quality, fitness for purpose)
• Consumer Rights Act does not apply to Dutch auction trade purchases
• Buyer is fully responsible for checking roadworthiness before using the vehicle
• Delivery does not change the trade status or imply mechanical assessment
• Delivery does not confirm suitability for road use

This is compliant with Section 2 of the Consumer Rights Act 2015, which applies to public/trade auctions where inspection is offered.

🚚 2. DELIVERY PROCESS

Booking Delivery
• Delivery is a separate, chargeable service, arranged after purchase.
• Full payment for the vehicle must be received before delivery is booked.
• Delivery fees become non-refundable once a driver or transporter is allocated.

Upon Delivery
• The vehicle will be handed over at the agreed location.
• Relevant paperwork will be provided or left securely inside the vehicle.
• A delivery note may be signed to confirm handover.

Delivery Areas
• UK mainland delivery available
• Highlands, Islands and remote areas quoted individually

🧾 3. COLLECTION FROM SITE

Customers may collect vehicles directly from our premises.

Amber Vehicles
• May be driven away only if roadworthy, insured, and taxed.
• Buyer is solely responsible for assessing roadworthiness before driving.

Red Vehicles
• Must be recovered or transported.
• Cannot legally be driven on public roads.

📝 4. NON-INSPECTION WAIVER (TRADE VEHICLES)

If a buyer chooses not to inspect an Amber or Red vehicle prior to collection or delivery, they must sign a Non-Inspection Disclaimer confirming:
• The vehicle is sold as seen
• It is unprepared and may be unroadworthy
• No warranty or consumer rights apply
• Delivery does not constitute a mechanical inspection

This protects both parties and ensures the buyer understands the nature of the purchase.

UNROADWORTHY AND DEFECTIVE VEHICLES

The Buyer agrees that if a Vehicle:

is in such a condition (whether by reason of its construction, the state of its brakes, steering, tyres, lighting equipment, reflectors or other parts) that it is unroadworthy or cannot otherwise be used lawfully on a road; and/or does not have a valid Driver and Vehicle Standards Agency MOT test certificate or plating document or any other document required by law, then the Buyer will not use the Vehicle on any road or remove it under its own power from the place at which it is located at the time of the Auction until it is roadworthy, can be used lawfully on the road and has all necessary documents.
